Right of Withdrawal

The Customer has a period of fourteen (14) calendar days, counted from the date of receipt of the product or from the conclusion of the sales contract in the case of the provision of a service, in which to exercise the right of withdrawal, regulated under Article 102 of Royal Legislative Decree 1/2007, of 16 November, approving the recast text of the General Law for the Defence of Consumers and Users and other complementary laws, hereinafter RDL 1/2007. With this information and the provisions set out in these terms, The Shop Gamer fulfils its duty to provide information and documentation regarding the right of withdrawal; therefore, this right shall not be extended for up to twelve months from the expiry date of the initial withdrawal period, pursuant to Article 105 of RDL 1/2007.

The right of withdrawal shall not apply to the contracts referred to and listed in Article 103 of RDL 1/2007. It likewise does not apply to withdrawal from the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene, such as headphones, earbuds or similar items, and products whose seal has been broken following delivery, such as consoles or other devices, particularly if they require registration and/or are activated using user credentials.

Customers may not withdraw from their purchase where the product acquired involves the supply of sealed audio or video recordings or sealed computer software that has been unsealed by the consumer and user after delivery, such as video games.

Nor may they withdraw where they have acquired digital content not supplied on a tangible medium once performance has begun.

In all cases where the right of withdrawal applies, the customer, who may withdraw from the product purchased without penalty and without stating the reasons to The Shop Gamer, shall follow the returns procedure, which begins with a request sent by email to sac@theshopgamer.com, who will provide a return number and a specific form sent to the requesting email, in which the customer must state the order or invoice number and other details relating to their purchase.

In any event, The Shop Gamer always delivers its products duly packaged, shrink-wrapped and with original seals, including their documentation and/or instructions, this being the only way in which they are considered to be in perfect condition; the product to be returned must therefore be in the same packaging condition, with no dents, no external items attached and no signs of deterioration.

Once the customer has received the return number, they will send the product to The Shop Gamer following the instructions provided and at their own shipping cost.

Should the return not be made using the original delivery packaging, The Shop Gamer may charge an additional cost, which will be communicated to the customer in advance through the same communication channel used to arrange the return. The Shop Gamer may follow the same procedure to inform the customer of a reduction in the amount to be refunded based on the packaging cost.

The Shop Gamer will refund, before 14 calendar days have elapsed from the date it was informed of the withdrawal decision, all payments received in relation to the product being returned, including, where applicable, delivery costs, without undue delay, unless the delivery method chosen by the customer differs from the least costly standard delivery method.
